1. Eligibility

  • You must be at least 18 years old or the age of majority in your jurisdiction to use Raisora.com.
  • By using the Platform, you represent that you have the legal capacity to enter into binding agreements.
  • Businesses or entities registering as sellers must be legally established and authorized to operate in their jurisdiction.

2. Accounts

  • Registration: To buy or sell on Raisora.com, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
  • Account Security: You are responsible for all activities under your account. Notify us immediately at support@raisora.com if you suspect unauthorized use.
  • Account Termination: We reserve the right to suspend or terminate accounts for violations of these Terms, including fraudulent activity, misrepresentation, or abuse of the Platform.

3. Role of Raisora.com

  • Platform Facilitator: Raisora.com is a marketplace that facilitates transactions between buyers and independent sellers. We are not a party to the sales contract between buyers and sellers. Sellers are responsible for their listings, product descriptions, pricing, shipping, and customer service.
  • Transparency: We require sellers to provide clear and accurate policies (e.g., returns, refunds, shipping). Buyers must review these policies before purchasing, as outlined in our Returns & Refunds page.
  • Dispute Resolution: While sellers handle returns and refunds, Raisora.com may mediate disputes to ensure fairness. Contact support@raisora.com if you cannot resolve an issue with a seller.

4. Buyer Responsibilities

  • Review Seller Policies: Each seller sets their own policies for returns, refunds, shipping, and product conditions. It is your responsibility to review these policies before purchasing.
  • Accurate Information: Provide accurate billing and shipping information to ensure successful delivery.
  • Payment: You agree to pay the full amount, including taxes and shipping fees, as displayed at checkout. Payments are processed through secure third-party providers.
  • Prohibited Actions: You may not use the Platform to purchase illegal items, engage in fraudulent transactions, or violate seller policies.

5. Seller Responsibilities

  • Accurate Listings: Sellers must provide truthful and complete product descriptions, including condition, specifications, and any defects.
  • Policy Compliance: Sellers must clearly state their return, refund, and shipping policies, adhering to applicable laws and Raisora’s guidelines.
  • Order Fulfillment: Sellers are responsible for timely shipping, providing tracking information (if applicable), and addressing customer inquiries.
  • Legal Compliance: Sellers must comply with all applicable laws, including tax obligations, intellectual property rights, and consumer protection regulations.
  • Fees: Sellers agree to pay Raisora.com a commission (depending on the product category) for each sale. Fees are detailed in the Seller Resources page.

6. Prohibited Activities

You agree not to:

  • Post or purchase illegal, counterfeit, or prohibited items (e.g., weapons, drugs, or hazardous materials).
  • Use the Platform for fraudulent, deceptive, or unlawful purposes.
  • Infringement intellectual property rights, including copyrights, trademarks, or patents.
  • Engage in spamming, harassment, or abusive behavior toward other users.
  • Attempt to hack, disrupt, or bypass the Platform’s security measures.

Raisora.com reserves the right to remove listings, suspend accounts, or take legal action for violations.

7. Payments and Fees

  • Buyers: Payments are processed securely through third-party providers. You authorize us and our payment processors to charge your selected payment method.
  • Sellers: Payments for sales are deposited to your designated bank account or PayPal, typically within 5-7 business days, minus applicable commission fees.
  • Taxes: Buyers and sellers are responsible for applicable taxes. Sellers must provide accurate tax information and comply with tax laws in their jurisdiction.
  • Currency: All transactions are processed in USD unless otherwise specified by the seller.

8. Returns and Refunds

  • Each seller sets their own return and refund policies, which may vary by store. Review these policies before purchasing, as outlined in our Returns & Refunds page.
  • Raisora.com facilitates communication between buyers and sellers but is not responsible for executing returns or refunds.
  • For disputes, contact support@raisora.com. We may mediate to ensure fairness but cannot guarantee specific outcomes.

9. Intellectual Property

  • User Content: By posting content (e.g., listings, images, or reviews), you grant Raisora.com a non-exclusive, worldwide, royalty-free license to use, display, and reproduce it for Platform operations and marketing.
  • Infringement: You must not post content that violates third-party intellectual property rights. Report infringement claims to legal@raisora.com.
  • Raisora’s IP: The Platform’s logos, designs, and content are owned by Raisora, Inc. and may not be used without permission.

10. Limitation of Liability

  • As-Is Service: Raisora.com is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose.
  • No Liability for Seller Actions: We are not liable for seller conduct, including inaccurate listings, delayed shipping, or failure to fulfill orders.
  • Damages: To the fullest extent permitted by law, Raisora.com, its affiliates, and partners shall not be liable for indirect, incidental, or consequential damages arising from your use of the Platform.

11. Indemnification

You agree to indemnify and hold Raisora.com, its affiliates, officers, and employees harmless from any claims, losses, or damages arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

12. Dispute Resolution

  • Informal Resolution: For issues with sellers, first attempt to resolve them directly. If unresolved, contact support@raisora.com for mediation.
  • Governing Law: These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
  • Arbitration: Any disputes not resolved informally shall be settled by binding arbitration in Delaware, USA, under the rules of the American Arbitration Association. You waive the right to participate in class actions.
  • Jurisdiction: For matters not subject to arbitration, you agree to the exclusive jurisdiction of courts in Paderborn.

13. Termination

  • You may close your account at any time by contacting support@raisora.com, subject to any outstanding obligations (e.g., pending orders or payments).
  • We may suspend or terminate your access for violations of these Terms, legal requirements, or at our discretion with notice.

14. Modifications to Terms

We may update these Terms periodically to reflect changes in our services or legal requirements. Updates will be posted on this page, and significant changes will be communicated via email or Platform notification. Continued use of Raisora.com after changes constitutes acceptance of the new Terms.
